07/13/2010 - The National Law Journal Quotes Martin Schwimmer on Lady Gaga Suit
Martin Schwimmer was quoted in the June 29 edition of The National Law Journal about stopping the sale of knockoff merchandise at summer concerts through the use of John Doe complaints, as illustrated by the recent trademark suit filed by Lady Gaga's merchandising company, Bravado International. In the article, Marty is quoted as stating: "If you can articulate with specificity what your rights are, your unambiguous rights, then you are providing a blue print for a [U.S.] marshal," Schwimmer said. "You don't want the marshal to need to exercise discretion." However, it should be clear as to what is and is not an infringement, because the remedy, ex parte seizure, is so severe. Please click here to view the complete article.
